Outdoor public-assembly facilities (e.g., amusement/theme parks) with sustained high attendance—not temporary event venues covered by TFRs.

Broadcast, wireless, satellite, and high-throughput data-center facilities where disruption would have regional or national communications impact.

Manufacturing in NAICS-aligned critical functional areas with exposed operations (no enclosed walls/roofs on critical components).

High- or significant-hazard dams meeting energy, water supply, or delivery thresholds; or navigation locks with high annual traffic.

DoD contractors/subcontractors in the U.S. performing mission-critical defense production or support functions.

State prisons (felony confinement) or correctional facilities housing 500 or more inmates.

Large power generation (≥500 MW), high-voltage substations (≥500 kV, or ≥345 kV in ERCOT), oil refineries (≥100,000 bpd), or natural gas processing (≥500 MMcf/d).

Corporate headquarters, cash operations, trading floors/exchanges, and third-party financial service providers meeting NPRM qualitative criteria.

The FAA has not developed eligibility criteria for this sector in the proposed rule. Criteria are RESERVED pending public comment.

High-risk, high-security government facilities with national/homeland security roles and documented risk management measures.

Level I trauma centers or pediatric Level I trauma centers with helipad(s).

Data centers and networking infrastructure where loss would debilitate national security, defense, or critical government operations.

Operating nuclear power plants, fuel cycle facilities, spent fuel storage, isotope production, and research/test reactors.

Fixed-site rail secure areas, intermodal hubs, critical pipeline infrastructure, major bridges/tunnels, and MTSA maritime facilities.
